1) The VEB reached a settlement with other investors outside the USA concerning the damage they incurred in the re-classification of the oil reserves in 2004. Shell provide funds of 340.1 million dollar for their investors outside USA. Furthermore there is a sum of 12.5 million dollar available to be equally divided among their investors. Parties have submitted their settlement to the Court in Amsterdam with a request to declare this binding. The case has been heard in Amsterdam on 20th November 2008. The VEB is confident that the required declaration will happen during the first half of 2009 so that after the filing of the required claim forms the pay out can start at the end of 2009 or start of 2010.
2) The settlement with American investors in April 2008 also has a positive effect for non-American investors: there is an extra 28 million dollar available for distribution outside the USA. Furthermore interest will be paid on all amounts payable from 1st April 2008. This extra compensation came after the VEB had made an agreement with Shell in case American investors were to receive a higher compensation compared with the non-American investors. 3) The SEC declared last year that the fine of 120 million dollar will be made available to Shell investors. This is completely separated from the Shell settlement reached between the parties. However, the closing period (18th November 2008) has already elapsed for the submission of a claim. In summary claim forms for the Shell settlement are not yet available.
